Not every investment in a property can be treated equally under tenancy law. Pure maintenance and repair costs serve to restore the original condition. Certain modernisation measures, however, may justify a rent adjustment subject to legal requirements.

That is why we clearly separate pure maintenance, cosmetic renovation, and value-adding modernisation in the measures plan — with traceable cost documentation.

§559 BGB

Legally defined modernisation measures can justify an annual rent increase of up to 8% of the costs incurred. Maintenance shares must be deducted. Modernisation notices are subject to strict formal requirements. We recommend individual legal advice from qualified partners.
