What Mietrechtspaket II specifically changes — and when it applies
Under Mietrechtspaket II (§ 556d Abs. 1a BGB-E, cabinet decision 29 April 2026), the furnished apartment surcharge in tight housing markets such as Munich may not exceed 10% of the net cold rent, or alternatively 1% of the furniture's current market value per month — whichever is lower. The surcharge must be disclosed proactively and separately before the lease is signed; without this disclosure, the apartment is legally treated as unfurnished. After its first Bundestag reading on 9 July 2026, the law is expected to enter force in autumn 2026.
